Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Scrub to Scale websites (including scrubtoscale.com, shop.scrubtoscale.com, resources.scrubtoscale.com, and app.scrubtoscale.com), the digital products we sell, and the Scrub to Scale software platform (together, the “Service”), operated by Scrub to Scale LLC (“we,” “our,” “us”), a Pennsylvania limited liability company. By buying a digital product, creating an account, or using the Service, you agree to be bound by these Terms.

1. Eligibility & Account

You must be at least 18 years old and have authority to enter into these Terms on behalf of yourself or the business you represent. Where the Service involves a login, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

2. Digital Products (One-Time Purchases)

We sell one-time digital products, currently Maigan's Pricing Calculator and Maigan's Hiring Bundle (each a “Product”), through our checkout pages at shop.scrubtoscale.com. Checkout runs on our checkout provider (GoHighLevel, also known as LeadConnector) and payments are handled by its payment processors. We never see your full card number.

  • Delivery. Access details are emailed to the address you enter at checkout, normally within minutes of payment. It is your responsibility to enter a working email address. A Product may be delivered as a hosted tool, as files, or through a login at app.scrubtoscale.com, and we may change the delivery method over time with reasonable notice.
  • Your licence. When you buy a Product, we grant you a non-exclusive, non-transferable licence to use it in one business that you own or operate. You may put your own name, logo, colors, and details on the Hiring Bundle documents and use the finished documents with your own employees, contractors, and customers. You may use the Pricing Calculator to price your own jobs.
  • What you may not do. You may not resell, share, give away, publish, sublicense, or redistribute a Product or any part of it (including access links, logins, files, formulas, and the unbranded templates); use it to build or offer a competing product or service; remove our copyright notices; or use it for any business other than your own without our written permission.
  • Ownership. The Products, including their text, design, code, formulas, and structure, are owned by Scrub to Scale LLC and protected by copyright. Buying a Product does not transfer ownership to you.
  • Not professional advice. The Hiring Bundle contains templates based on the documents used in Maigan's own cleaning company. They are not legal, HR, tax, or accounting advice, and employment law varies by state. Have a licensed professional review them for your state before you rely on them. The Pricing Calculator produces estimates from the numbers you enter; you are responsible for the prices you charge.
  • All sales final. Because Products are delivered instantly, all sales are final. See our Refund Policy for the few exceptions, such as duplicate charges.
  • Prices and add-ons. Prices are shown in US dollars and may change at any time. Changes do not affect purchases you have already made. Add-ons you accept at checkout are part of the same order and subject to these Terms.
  • Updates. We may improve a Product over time and may make updates available to existing buyers at our discretion.

3. Software Subscriptions & Billing

The Scrub to Scale software platform is offered on a subscription basis. By subscribing, you authorize us (through our payment processor, Stripe) to charge your payment method on a recurring basis (monthly or as otherwise stated at checkout) until you cancel.

  • Subscription fees are billed in advance and are non-refundable.
  • If we offer a free trial, you may cancel during the trial period at no charge. If you do not cancel before the trial ends, your payment method will automatically be charged for the next billing cycle.
  • You can cancel your subscription at any time from your billing dashboard. Cancellation stops future renewals; it does not refund the current billing period.
  • Prices may change. We will give reasonable notice before any price increase takes effect.

4. Refunds

All sales are final, for digital products and for subscriptions. We do not provide refunds for digital products after delivery, or for subscription fees, unused time, partial billing periods, or cancellation. Please review our Refund Policy for full details, including how we handle duplicate charges and access problems.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any law, regulation, or third-party rights;
  • Send spam, unsolicited messages, or unlawful communications via webhook integrations or notifications;
  • Attempt to interfere with, reverse engineer, or compromise the Service;
  • Use the Service to collect, store, or process information in violation of applicable privacy laws;
  • Collect, store, or transmit protected health information (PHI) or other HIPAA-regulated health data. The Service is not HIPAA-eligible and we do not sign Business Associate Agreements unless expressly agreed in writing;
  • Collect data from children (e.g. subject to COPPA or GDPR-K), or collect government identifiers, financial account numbers, or other regulated sensitive data through your forms without a lawful basis and any required authorization;
  • Resell, sublicense, or rebrand the Service or any Product without our written permission.

6. Your Content

You retain ownership of all data and content you submit to the Service (pricing configurations, customer leads, branding, company details entered into a Product, etc.). You grant us a limited license to host, process, and display this content solely as necessary to operate the Service and deliver the Products.

7. Termination

You may terminate a software account at any time by canceling your subscription. We may suspend or terminate your account, or revoke access to a Product, if you violate these Terms, fail to pay, initiate a chargeback for a charge you authorized, or use the Service in a way that creates risk for us or other users. On termination, your right to use the Service ends immediately. We may retain or delete your data per our Privacy Policy and applicable law.

8. Disclaimers

THE SERVICE AND THE PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Pricing estimates produced by the Service or a Product are advisory; you are solely responsible for the prices you charge and the pricing logic you configure. Templates and documents in a Product are not legal advice and are provided on the basis that you will have them reviewed for your own jurisdiction.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SCRUB TO SCALE LLC, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY ARISING FROM OR RELATING TO THESE TERMS SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless Scrub to Scale LLC and its affiliates from any claims, damages, or expenses arising from your use of the Service or a Product, your Content, the documents you create with a Product, or your violation of these Terms.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you (e.g., by email or in-app notice) and update the “Effective” date at the top of this page. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law & Disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of laws principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Pennsylvania, and you consent to the personal jurisdiction of those courts.

13. Copyright Infringement (DMCA)

We respect intellectual-property rights and respond to valid notices of claimed copyright infringement under the Digital Millennium Copyright Act.
